C. and Langworthy, for the plaintiffs, in support of the bill, contended that the court had now this jurisdiction. Marlineau, for the defendants opposing a sale. The Vice-chancellor said that, in his opinion, the 4th section of the Act was retrospsctive, and that the court should be satisfied, before directing a decree for a sale of the land as prayed, .that such sale would not be injurious to the interests of the parties interested in the lands, and that the defendants, who by their answer had objected to a sale, should have an opportunity ot filing affidavits to show that such sale would be injurious to them. The cause would therefore stand over for a fortnight to enable those defendants to file such affidavits. The costs of the suit to abide the result. Order accordingly. Solicitors: J. The publication of a full and faithful report of a debate in either House of Parliament is privileged, and an action for libel cannot be maintained against the publisher, although the speeches contain matter defamatory of an individual. The grounds on which exemption from legal liability is extended to the publication of the proceedings of courts of justice, apply equally to the publication of proceedings in Parliament, viz., (1) that the prima facie presumption of malice is rebutted by the occasion of publication, and (2) that the advantage to the general public resulting from publication, counterbalances th...
